The Swimming Pool Complex was created in order to enrich the offer of active recreation for owners of apartments in the "Phoenix Seaside Estate", who have a share in the complex.
The attractions offered in the Swimming Pool Complex may be used by its co-owners and their guests and residents on terms specified in these regulations.
1. DEFINITIONS
a. co-owner - a person who has a share in the co-ownership of the property on which the Swimming
Pool Complex is located or a person with whom a preliminary agreement for the sale of such share has been concluded;
b. resident - a person staying in the apartment belonging to the co-owner, for more than a day, on the premises of the Phoenix Estate, reported to the administrator by the co-owner;
c. guest - a person temporarily staying on the premises of the Feniks Estate;
d. administrator - the entity managing the Swimming Pool Complex on behalf of the co-owners -Feniks Estate Administration Ltd;
e. Swimming Pool Complex - a real property located on lot 4/417 in Kolobrzeg at Poleska 6 Street, consisting of an outdoor swimming pool, playroom, gym, indoor swimming pool, locker room and administration room;
f. outdoor swimming pool - an area comprising a swimming pool basin of 24.90 x 7.5 m with a depth of 1.3 m and a paddling pool with an area of 165 m2 and a depth of 0.2 to 0.4 m, a swimming pool beach around the basin and a terrace above the playroom and gym;
g. indoor swimming pool - an area comprising an indoor swimming pool basin measuring 11m x 5.5m and 1.2m deep, a Jacuzzi, a sauna and a mezzanine area;
h. changing rooms - rooms with lockers, changing rooms and showers located between the entrance hall and the indoor swimming pool;
i. entry card - a registered card, assigned to a specific dwelling unit, allowing access to the swimming pool complex during its opening hours;
j. user - an authorized person residing within the swimming pool complex;
2. AVAILABILITY
a. Access to the pool complex is available to co-owners and residents.
b. Guests are allowed in the pool complex only when accompanied by co-owners.
3. REGISTRATION/ADMISSION CARDS/MAINTENANCE/OPERATING FEES
a. Admission card registration and activation is done through the administrator
b. Maintenance costs of the complex shall be borne by the co-owners, as part of the settlement fee.
c. Maintenance costs are collected by the administrator.
d. Activation costs for year-round cards are collected as part of the settlement fee.
e. A fee of 2000 PLN will be charged for giving the entry card to an unauthorized person and
deactivating all cards issued to the property for 6 months.
f. Children under 4 years of age enter without a card, when accompanied by a parent or caretaker.
g. There are 4 entry cards issued per dwelling unit as part of the settlement fee.
h. A co-owner may purchase an additional card for the entire year as an increase in the housing development fee. The cost of the additional card is PLN 20 per month.
i. Loss of the card must be immediately reported to the administration.
4. GENERAL SECURITY AND ORDER RULES
a. A person using the POOL COMPLEX is obliged to become familiar with these rules. Entering the basin combination is at the same time confirmation of becoming familiar with the regulations and obligation to comply with them.
b. The Pool Complex shall be used in a manner that allows uninterrupted use by others.
c. Co-owners providing entry cards to other persons shall be responsible for familiarizing such persons with these rules and regulations and shall be fully responsible for the safety of such persons while using the Pool Complex and shall be liable for damages caused by the conduct of such persons as for their own conduct.
d. The Administrator has the right to eject users who do not conform to the rules of observing silence or in any way cause discomfort to others using the POOL COMPLEX.
e. The user is obliged to observe safety signs and to follow the information posted in the POOL COMPLEX.
f. Youth under 18 years of age may use the POOL COMPLEX only with consent and in presence of a parent or legal guardian.
g. Children under 3 years of age are required to wear swim diapers.
h. Visitors whose health condition may deteriorate while using the POOL COMPLEX as well as those whose health condition is unstable (in particular cardiac diseases, circulatory or balance disorders or similar) use the POOL COMPLEX at their own risk.
i. The POOL COMPLEX administrator is not responsible for lost and left valuables, especially such as jewelry, phones, cameras, money.
j. The user takes full financial responsibility for any damage caused by him or persons for whom he is responsible.
k. Any user violating public order or the POOL COMPLEX rules will be expelled from the POOL COMPLEX.
l. The administrator of the POOL COMPLEX is not liable for the user's failure to observe the relevant rules and regulations of the POOL COMPLEX.
5. OUTDOOR SWIMMING POOL
a. The depths of individual pools are:
- sports pool 130 cm,
- paddling pool from 20 to 40 cm.
b. Before entering the swimming pool area and using individual devices, a user should read the regulations and relevant instructions for use.
c. Children under 13 years of age may stay at the pool under the supervision of an adult person. It is recommended that children use safety vests.
d. Children under 3 years of age are required to wear swim diapers.
e. Swimming pool users are required to change their footwear for swimming pool flip-flops.
f. Swimwear suitable for pool water is mandatory at the pool.
g. Each person is required to wash under the shower and disinfect their feet before entering the pool.
h. When using the pool, the instructions of the staff and graphic signs must be strictly adhered to.
i. Jumping into the water is prohibited.
j. Persons violating public order, the regulations, not following the recommendations of lifeguards and administrative staff may be removed from the premises.
k. All persons in the facility must immediately obey announcements made by the facility staff and lifeguard
l. The following are prohibited in the swimming pool area:
- smoking cigarettes and consuming alcoholic beverages,
- Bringing in glass containers, sharp tools and other dangerous items,
- making noise and littering the facility premises,
- bringing in and presence of animals,
- Entry of persons whose condition indicates consumption of alcohol or other intoxicants,
- Entry of persons whose health condition may pose a drowning hazard and endanger the health of other pool users,
- running on the beaches surrounding the swimming pool basins,
- pushing or throwing other users into the water,
- pollute, throw food leftovers and any objects into the water,
- use soap or other chemicals,
- leaving pool slippers in the communication areas,
- swimming in contact lenses.
m. Persons whose outward signs indicate skin diseases, open cuts, infectious diseases, hard-to-heal wounds, lack of personal hygiene, frequent intravenous injections on upper extremities, breathing difficulties, balance disorders, aggressive behavior are prohibited from using the pool.
n. Persons with unstable health conditions should use the pool with extreme caution or after consultation with a physician. The administrator is not responsible for the health consequences of being in the facility.
o. Damage to or loss of facility equipment and contamination of pool water is subject to a 100% damage fee.
p. The administration is not responsible for accidents caused by failure to observe the "Rules".
6. INDOOR SWIMMING POOL
a. The indoor pool is not guarded by a lifeguard
b. The depth of the inner pool is 1.2 m
c. Before entering the pool area and using individual pieces of equipment, please familiarize yourself with the rules and regulations and relevant instructions for use.
d. Children under 13 years of age in the care of an adult. It is recommended that children use safety vests.
e. Children under 3 years of age are required to wear swim diapers.
f. Persons staying in the indoor swimming pool area are obliged to change their footwear and change into swimwear in the changing room. Swimwear adjusted to the pool water is obligatory atthe pool.
g. Each person is required to wash under the shower and disinfect their feet before entering the pool.
h. While using the pool one should strictly follow the instructions of the staff and graphic signs
i. Jumping into the water is prohibited
j. Persons violating public order, the regulations, disobeying the recommendations of lifeguards and administrative staff may be removed from the premises.
k. All persons in the pool area must immediately obey the announcements made by the facility staff and lifeguard
l. The following are prohibited in the swimming pool area:
a. smoking cigarettes and consuming alcoholic beverages,
b. Bringing in glass containers, sharp tools and other dangerous items,
c. making noise and littering the facility premises,
d. Bringing in or remaining with animals,
e. Entry of persons whose condition indicates consumption of alcohol or other intoxicants,
f. Entry of persons whose health condition may pose a drowning hazard and health risk to other pool users,
g. running on the beaches surrounding the pool basins,
h. push or throw other users into the water,
i. to consume food items within the pool hall, including in particular "chewing gum",
j. pollute, throw food leftovers and any other objects into the water,
k. to use soap and other chemical agents,
l. to leave swimming pool flip-flops in communication areas,
m. to swim in contact lenses.
m. Persons whose outward signs indicate skin diseases, open cuts, infectious diseases, hard-to-heal wounds, lack of personal hygiene, frequent intravenous injections on upper extremities, breathing difficulties, balance disorders, aggressive behavior are prohibited from using the pool.
n. Persons with unstable health conditions should use the pool with extreme caution or after consultation with a physician. The administrator is not responsible for the health consequences of being in the facility.

7. GYM
a. Individuals using the gym should, for their own safety, complete a medical examination to
determine there are no contraindications to attending the gym.
b. All persons using the gym are required to wear sports attire and footwear.
c. Due to hygiene and equipment maintenance recommendations, the use of towels that are placed on the exercise stations used is mandatory.
d. The staff of the complex has the right to refuse entry to the gym to persons without appropriate sports attire for exercise, especially footwear.
e. Persons under 18 years of age can use the gym with the knowledge and written consent of their caretaker (at the request of staff, customers are required to show a document confirming identity).
f. Children under 13 years of age are not allowed in the gym.
g. Exercising on the equipment is performed after reading the equipment instructions.
h. Exercisers are obliged to perform exercises safely, i.e., exercise with loads they are able to control themselves.
i. Persons using the gym who feel unwell during exercises or stay at the gym are obliged to stop exercising immediately.
j. A warm-up is required prior to exercise to avoid injury.
k. Using the equipment should be done in a safe manner, i.e. with care for the safety of people, respect for the equipment and the room.
l. The condition of the equipment should be checked before exercising - any defects, damage to equipment and instruments should be reported to the administration.
m. All gym equipment and exercise equipment may only be used for their intended purpose.
n. It is inadvisable to occupy exercise stations while resting.
8. PLAYROOM
a. The playroom is designed for children from 1 year to 13 years old
b. The play structure (the Monkey Grove) may be used by children over 3 years of age
c. Children stay in the playroom under the supervision of their parents (caretakers).
d. Caretakers leaving children alone in the playroom do so solely at their own risk.
e. It is forbidden to wear outer clothing and shoes in the playroom.
f. Children shall enter in socks or slippers.
g. Caretakers enter the playroom wearing socks.
h. Children may not wear: glasses, watches, chains or any sharp or dangerous objects while playing.
i. Parents and caretakers are prohibited from entering the structure.
j. For the sake of the health of our youngest customers, children or adults who are carriers of contagious diseases, viral or bacterial infections are not allowed in the playroom.
k. In case of any random events or accidents in the Playroom, in which a child or custodian is injured, this fact should be immediately reported in writing with a medical opinion to the Administrator
l. The Administration may expel children who cause behavioral problems and pose a threat to other children.
m. Parents (caretakers) are responsible for damages caused for children and are obliged to repair or buy back damaged toys or equipment. The Playroom is responsible for the technical condition and safety of the equipment
n. In the Playroom it is forbidden to:
- climbing on the external walls (nets) of the play structure,
- Jumping from the slide into the pool,
- Entering areas that are excluded from play,
- Damage to structures, toys or decorations.
